License Agreement

Subject to your compliance with this Agreement, we grant you a non-exclusive, perpetual, worldwide, non-transferable license to use each Licensed Image for the permitted uses below. The license for an image takes effect once that image is paid for, or downloaded under an active access plan, and does not expire — including if your membership later ends.

You may use Licensed Images for virtually any lawful purpose, including:

• Commercial use — advertising, marketing, and promotion.
• Websites, apps, social media, and digital content.
• Print: brochures, signage, presentations, and publications.
• Real-estate listings and property marketing.
• Editorial and internal business use.
• Client work and deliverables produced by you.

You may crop, color-correct, retouch, and incorporate Licensed Images into your own designs and creative works.

You may not:

• Resell, sublicense, rent, lend, or otherwise redistribute a Licensed Image as a standalone file, or in any form where the image itself is the primary value (e.g. stock libraries, templates, NFTs, or print-on-demand products).
• Share, transfer, or give the original file or your account to anyone else.
• Claim authorship of, or assert ownership or copyright in, the imagery.
• Use a Licensed Image in any unlawful, defamatory, or misleading manner, or in a way that implies endorsement by any person or brand depicted without their permission.
• Remove, obscure, or alter any copyright or attribution metadata.

We (or the photographer) retain all copyright and ownership in the imagery. This Agreement licenses the imagery to you; it does not transfer copyright or sell the image to you.

Watermarked preview images shown while browsing are for evaluation only and may not be used for any other purpose. Only the full-resolution original you license may be used under this Agreement.

If you hold an active membership or access plan, the same per-image license above applies to each image you download while your plan is active. Images you download during an active plan remain licensed to you permanently, even if the plan later ends. A plan does not grant any rights beyond the licenses for images you actually download.

Aerial imagery may depict private property, people, vehicles, trademarks, or artwork. We do not provide property or model releases. You are responsible for ensuring your particular use complies with all applicable laws — including privacy, publicity, trademark, and property rights — and for obtaining any releases or permissions your use requires.

Imagery is provided “as is” and “as available,” without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose, or non-infringement.

To the maximum extent permitted by law, our total liability arising out of or relating to a Licensed Image or this Agreement will not exceed the amount you paid for that image. We will not be liable for any indirect, incidental, or consequential damages.

We may update this Agreement from time to time. The version in effect at the time you license an image governs that image.

This Agreement is governed by the laws of the State of Texas, USA, without regard to its conflict-of-laws rules.
